Terms of service

These terms govern access to this website and, where a tenant agreement does not say otherwise, the RemoteRegister platform.

Last updated: 24 October 2026

1. Agreement

By accessing this website or using the platform, you agree to these terms. If you use the platform on behalf of an organisation, you confirm that you are authorised to bind that organisation. A signed tenant agreement, order form or data processing agreement takes precedence over these terms where they conflict.

2. The service

RemoteRegister provides software for learnership administration, attendance evidence, workplace learning, stipend calculation, statutory reporting and related compliance workflows. The service is provided as software; it is not legal, tax, audit or accounting advice.

Some capabilities depend on third-party providers, certifications or credentials. The Trust Centre describes the current status of each integration. A simulator or sandbox mode is not a live government, bank or payment connection.

3. Accounts and access

  • You must keep credentials confidential and notify us promptly of suspected compromise.
  • You may not share an account between people; each user must have their own identity.
  • Role and tenant permissions are enforced by the platform. Attempting to bypass them is a material breach.
  • We may suspend access to protect the platform, a tenant or a data subject, with notice where practicable.

4. Acceptable use

You may not:

  • Use the service to process personal information without a lawful basis.
  • Upload malicious code, attempt unauthorised access, or interfere with the integrity of the audit ledger.
  • Scrape, reverse engineer or resell the service except as permitted by a written agreement.
  • Use the service to discriminate unlawfully or to make automated decisions that require human judgement without human review.
  • Submit another person's identity or biometric information without their consent or another lawful basis.

5. Tenant responsibilities

A tenant is responsible for the accuracy of the data it uploads, the lawfulness of its processing, its own privacy notices and consents, the configuration of attendance and stipend policies, and the acts of its users. The tenant must ensure that any biometric deployment has a documented lawful basis and a practical alternative where required.

6. Fees and payment

Fees are set out in the order form or pricing schedule. Prices exclude VAT unless stated otherwise. External provider costs are pass-through charges and are itemised separately. Invoices are payable on the stated terms. We may suspend a tenant for material non-payment after notice.

7. Intellectual property

We retain all rights in the platform, its source code, documentation and trade marks. The tenant retains all rights in its data and grants us a limited licence to process it to provide the service. Feedback may be used to improve the platform without obligation, provided it contains no confidential tenant data.

8. Confidentiality

Each party will protect the other's confidential information with reasonable care and use it only for the purpose of the agreement. This does not apply to information that is public, independently developed, or required to be disclosed by law, provided the disclosing party is notified where lawful.

9. Availability, support and changes

We aim to keep the service available and will publish material incidents on the status page. Planned maintenance is communicated in advance where practicable. We may change features; a change that materially reduces a contracted capability will be handled under the tenant agreement. Deprecated API versions are announced before removal.

10. Data protection

Each party will comply with POPIA. Where we process personal information on a tenant's behalf, the data processing agreement governs the processing, subprocessors, security measures, breach notification and assistance with data-subject requests. Our privacy notice describes processing for which we are the responsible party.

11. Liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, loss of anticipated savings or loss of data caused by the other party's failure to back up. Our aggregate liability is limited to the fees paid or payable in the twelve months before the event giving rise to the claim, except for wilful misconduct, gross negligence, fraud, death or personal injury, or a breach of confidentiality or data protection obligations where the law does not permit limitation.

Nothing in these terms excludes liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 where it applies.

12. Term and termination

The agreement runs for the period stated in the order form. Either party may terminate for material breach after written notice and a reasonable opportunity to remedy. On termination, the tenant may export its data in a documented format during the agreed wind-down period. Audit-ledger entries may need to be retained to preserve integrity and meet statutory retention obligations.

13. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. The parties will attempt to resolve a dispute through good-faith discussion before litigation. Subject to any mandatory jurisdiction rule, the courts of South Africa have jurisdiction.

14. Changes and contact

We may update these terms. The date at the top will change, and material changes will be notified to tenant administrators. Questions: [email protected].

These terms are a baseline for the website and platform. A signed enterprise agreement may replace or supplement them. They are not legal advice to any reader.
